Cancellation Policy.

1. Purpose

This policy outlines the terms for cancellations, changes, transfers, substitutions, and refunds for enscarp training courses. By registering for a course, you agree to the terms of this policy. 

For the purposes of this policy, business days means Monday to Friday, excluding public holidays.

2. Cancellations & Changes

If you need to cancel or change your registration, please notify enscarp in writing (email) as early as possible, noting:

  • More than 10 business days before the course:
    • You may cancel your registration at no cost; or 
    • Request a transfer to a future session (subject to availability); or
    • Nominate a substitute participant (subject to enscarp’s approval).
  • Between 5–10 business days before the course:
    • Receive a 50% refund of the course fee paid; or
    • Request a transfer to a future session (subject to availability); or
    • Nominate a substitute participant (subject to enscarp’s approval).
  • Less than 5 business days before the course:
    • No refund will be provided. 
    • Nominate a substitute participant (subject to enscarp’s approval).

Where a participant is unable to attend due to exceptional or unforeseen circumstances, enscarp may, at its sole discretion, offer an alternative arrangement. 

Refunds will be processed to the original payment method where practicable.

3. Transfers to a Future Course

Registrations may be transferred to a future scheduled session, subject to availability, noting:

  • Each registration may be transferred once only.
  • The transferred registration must be used within six (6) months of the original course date.
  • Transferred registrations are not eligible for subsequent refunds.
  • Transfer requests must be submitted in writing via email.

4. Participant Substitutions

Participant substitutions are permitted up to 48 hours prior to course commencement.

  • Requests must be submitted in writing via email.
  • All substitutions are subject to enscarp’s approval.
  • Substitute participants must meet any applicable course prerequisites.

5. Non-Attendance

If you do not attend a scheduled course or session, no refund will be provided.

6. Changes or Cancellation by enscarp

enscarp reserves the right to reschedule, postpone, change the delivery format of, or cancel a course where required, including where minimum participant numbers are not met.

If enscarp cancels a course, participants will be offered either:

  • A full refund; or
  • A transfer to a future course session.

enscarp is not responsible for any additional costs incurred by participants, including travel, accommodation, loss of income, or other consequential expenses.

7. Online Training Requirements

Where a course is delivered online, participants are responsible for ensuring they have suitable internet access, equipment, software and an environment appropriate for participation.

Refunds will not be provided where a participant is unable to attend or participate due to their own technical difficulties or equipment limitations.

8. Registration, Payment and Confirmation

A registration is received when enscarp receives a completed registration request or booking instruction from a participant or purchasing organisation.

A place in a course is not guaranteed until payment has been received, and confirmation has been issued by enscarp.

Payment terms for training invoices are seven (7) days unless otherwise specified.

enscarp reserves the right to cancel unpaid registrations after the invoice due date and offer those places to participants on the waiting list.

Once a registration is confirmed, the cancellation and refund provisions of this policy apply.

9. General Legal Provisions

Force Majeure

enscarp will not be liable for delays, rescheduling, postponement or cancellation arising from events beyond its reasonable control, including but not limited to natural disasters, public health emergencies, industrial action, government restrictions, power outages, telecommunications failures or technology disruptions.

Limitation of Liability

To the maximum extent permitted by law, enscarp’s liability arising from or in connection with a training course is limited to the amount paid by the participant for that course.

enscarp will not be liable for any indirect, incidental, special, consequential or economic loss arising from participation in, or inability to attend, a course.

Australian Consumer Law

Nothing in this policy excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or any other applicable legislation.

10. Changes to this Policy

enscarp may amend this policy from time to time. The version of the policy in effect at the time of registration will apply to that registration.
